      &lt;br/&gt;&#xD;
      
           pediatric surgeon Colin Knight dis

    &lt;/span&gt;&#xD;
    
          missed — eventually — by the state, but the damage to the client’s reputation had already been done.
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    
          “If anybody runs a Google search on Dr. Colin Knight, the first three or four things that come up aren’t his surgical experience or his thousands of hours of community service. The stuff that comes up is him being accused of cybersnooping, which he never did,” Fox said.
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Knight, a doctor at Nicklaus Children’s Hospital in Miami, was accused in May 2017 by his ex-girlfriend, Grace Carricarte, of snooping on her via an
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    
          online surveillance feed using his personal computer and hospital network.
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Carricarte, a mental health therapist and adjunct lecturer at the University of Miami, claimed she installed security cameras in her Coral Gables home for peace of mind after a burglary, according to a 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;

    &lt;span&gt;&#xD;

          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;

           Before criminal charges were brought, Carricarte served Knight a civil injunction, ordering him to stay away from her.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “I wish that there had been a modicum of effort expended by the agencies that originally filed these charges,” Fox said.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Prosecutors dropped the charges July 23 after concluding they had insufficient evidence to prove Carricarte had not given Knight permission to access her surveillance feed.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           News

    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           reports indicated 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Knight’s employer stood by him, deciding not to suspend him, but Fox said the scandal hurt the doctor.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “I think (Carricarte) found something that she thought gave her some leverage over him so she could try to ruin his life, and that’s what she did,” Fox said.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    
          Carricarte and her lawyer, 
          &#xD;
    &lt;span&gt;&#xD;
      
           Robin Pimentel, 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           partner at the Law Offices of Pimentel and Castillo in Miami, did not respond to requests for comment before deadline.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           When Fox received a call from the State Attorney’s Office a few months later, he “knew it wasn’t a positive development.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “We talked a little bit about potentially not filing the case,” Fox said, “But (the State Attorney) said based on the heavy pressure that he was getting from the victim and her family, and the fact that he had found her credible, he was 99 percent certain that they were going to file charges.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    
          Knight was arrested in December 2017 and charged in February 2018 with 20 felony counts of unauthorized access to a computer, 20 counts of unlawfully accessing a computer device and one count of video voyeurism.
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Knight denied the charges, claiming Carricarte had asked him to check on her.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “Obviously, if somebody had given permission for you to use their cameras, you can’t be prosecuted for unauthorized use of their video cameras,” Fox said.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Fox claimed Knight was worried about Carricarte as he’d recently ended their relationship.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “She obviously was not happy about that decision and she wanted the relationship to continue,” he said.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           According to Fox, Carricarte reached out weeks later “to put things back together,” but Knight wanted the relationship to end.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           To support claims that Knight had permission to access the surveillance footage, Fox provided state prosecutor Derek Ko with sworn testimony from multiple witnesses.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In one deposition, a mutual friend of the couple, Charles Pinto, recalled Carricarte mentioning she’d given Knight access to her securiy cameras when he visited her home for a personal training session. Pinto claimed Carricarte mentioned Knight, as she laughed at her dog, which kept jumping on her.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “She said, ‘If Colin was watching this right now, it would be really funny. It would look really funny to him.’ And I remember we even looked over at her security cameras and waved,” Pinto said in the deposition.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Fox says Knight is now examining “all possible legal remedies”
           &#xD;
      &lt;br/&gt;&#xD;
      
           against Carricarte for “the malicious prosecution, and the defamation and slander of his character that has gone on for almost an entire year.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As a result of

    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           , Sunset Elementary School dropped Knight from its father-child bonding program, All Pro Dads.

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “The school didn’t feel comfortable having him involved,” Fox said.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Nicklaus Children’s Hospital also came under 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           scrutiny 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           for not firing him. Knight took a leave of absense in May but is set to return soon.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;

           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
    
          “I think there’s a danger, always, that people will rush to judgment without knowing the facts. The public can rush to judgment and that’s obviously dangerous, but it’s much more dangerous when a government agency, or a prosecutor’s office or a police force doesn’t do an investigation and simplymakes an arrest without knowing all the facts,” Fox said.
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Carricarte is still pursuing the civil injunction against Knight, which is set for a hearing on Aug. 17.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “It’s very difficult to undo a case,” Fox said. “It’s easy to make an arrest. It’s easy to arrest somebody; it’s easy to write ‘closed by arrest’ on a police file, but it’s hard to undo that.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “Larry and Brad are devoutly religious and refuse to take Covid vaccines as they are developed from and/or tested with aborted fetal cells,” read the statement, which said Pardo and Holman are working with a Miami-based law firm. “The Club pretended to offer Larry and Brad a chance to lay out their religious beliefs and request to be exempted from the requirements, which they did.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           "However, less than 36 hours after they each provided a written summary of the basis for their sincerely held religious beliefs to the Club, they received an acknowledgment from the Club purporting to recognize and respect their religious beliefs as sincere and legitimate.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In a statement responding to assertions about the Nationals’ process, a team spokeswoman wrote: “While we are not going to comment on specific exemptions, we took every request very seriously and applied a rigorous and interactive process to each request as is prescribed by applicable law.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The team’s evaluation process included a questionnaire and deliberation by outside counsel; the Nationals’ general counsel, Betsy Philpott; and members of their human relations department. Employees seeking an exemption then had a Zoom meeting with Philpott, according to two people with knowledge of the proceedings. Calls lasted 30 to 90 minutes, per a person familiar with the matter, and consisted of Philpott asking follow-up questions about each employee’s bid for a health or religious exemption.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           On Aug. 14, the Nationals notified all non-playing staff members that they had two weeks to show proof of full vaccination or a first shot, or file an exemption request. On Sept. 1, unvaccinated employees were placed on two weeks of unpaid administrative leave while exemption requests were reviewed. That included Holman and Pardo, whose contracts were officially terminated Wednesday, the end of their administrative leave. Their joint statement says the Nationals violated “their rights to free expression and observation of their sincerely held religious beliefs.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The statement adds that Pardo and Holman “could not and will not choose to take the vaccines even if it cost them their jobs, which it ultimately did.” It ends with a promise of “fighting this outrageous decision by the Nationals in the federal courts.” The Nationals told unvaccinated employees they could return to work if they received a first dose by Sept. 14.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Holman, 53, was the Nationals’ minor league pitching coordinator and joined the organization in 2018. Pardo, 55, was the pitching coach for the club’s Florida Complex League team and was also hired in 2018.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Pfizer and Moderna used cell lines from aborted fetal tissue to test whether the vaccines worked, but the vaccines were not developed from those lines. The Johnson &amp;amp; Johnson vaccine used lab-replicated fetal cells during its production process, but the vaccine does not contain fetal cells.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           While some groups have opposed or discouraged people from getting the Johnson &amp;amp; Johnson vaccine, major leaders of organized religions in the United States have endorsed getting a coronavirus vaccine. The Vatican has said it is morally acceptable to receive coronavirus vaccines that have used aborted fetuses in their research and production process because the “cooperation in evil” is considered remote.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           According to people with knowledge of the review process, religious exemption requests had to check two boxes: Are the religious beliefs sincere? And could the team grant an exemption without compromising the health and safety of other employees? With Pardo and Holman, the Nationals ruled yes on the former and no on the latter.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In the response letters to both coaches, the club wrote: “The company recognizes and respects your religious beliefs and would accommodate those beliefs if it could. However, in light of the fact that a fully approved vaccine is now available, and given the nature of your position, duties, and essential functions, your continued performance of your duties without being vaccinated will pose an unacceptable risk to the health of Company employees (including you), customers, visitors, and others with whom you are required to interact in connection with your job duties.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Alexander F. Fox, the attorney representing Pardo and Holman, said his clients will not speak with reporters while litigation is pending.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           Stoudemire’s ex-wife Alexis responded to their daughter’s “plea for help” in a Dec. 17 incident at his condo, according to a police report obtained by the Miami Herald. The former NBA center allegedly told Alexis, with whom he shares four children, including two daughters, 17 and 14, that their child was being “disrespectful” and “giving attitude” to her grandmother. He also told police she “received a whooping from him for being disrespectful and a liar.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Shortly after the incident, he

           A battery case against former NBA player Amar’e Stoudemire related to an allegation of an incident involving his daughter last month has been dropped, a Florida state's attorney said Tuesday.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           "The case was dropped due to the failure of the victim to cooperate in the prosecution of the criminal case," the Miami-Dade State Attorney's Office said in a statement.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Stoudemire, 40, a six-time NBA All-Star who retired from the league in 2016, said immediately after his 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;a href="https://www.nbcnews.com/news/sports/ex-nba-player-amare-stoudemire-arrested-allegedly-punching-slapping-da-rcna62301" target="_blank"&gt;&#xD;
      
           arrest in mid-December
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      
            that a full probe would show he's innocent.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           On Tuesday, Stoudemire credited authorities for the outcome.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           "Today, I’m grateful that after a full investigation, all charges were dismissed," Stoudemire said in a statement. "My faith in the goodness we all possess has never wavered and has never been greater."
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Stoudemire's attorney, Alexander Fox, said in a statement that the dismissal was "consistent with Mr. Stoudemire’s immediate and public denials of the allegations when they were brought and recognition of his innocence here." 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Authorities have not identified the alleged victim. The 
          &#xD;
    &lt;/span&gt;&#xD;

           reported Stoudemire has two daughters. The affidavit does not make clear which one authorities believe was the victim.

           An arrest affidavit alleged he attacked his daughter because she was being disrespectful to her grandmother.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Police who responded to Stoudemire's Miami-Dade County home Dec. 18 said he told them his daughter "had received a whooping from him for being disrespectful and a liar," according to the affidavit.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           He is alleged to have slapped her and punched her in the jaw, causing a bloody nose, according to the police document. Officers said that they “observed blood stains” on the victims’ sweater and pants and that her mother showed them a picture of the girl crying with blood running down her face.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Stoudemire then went silent under his constitutional right to do so, the affidavit states. He posted $1,500 bond on a misdemeanor battery charge and was freed the day of his arrest.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           After he retired from an NBA career that included playing for the Miami Heat, the Phoenix Suns, the Dallas Mavericks and the New York Knicks, Stoudemire, a center and power forward, played professional basketball in Israel.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           After his arrest, Stoudemire said his Jewish faith would pre-empt his ever doing anything so violent. He said Tuesday that "this chapter" in his life, in which his "family’s world was turned upside down," was now closed.
          &#xD;

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
